Law Enforcement Discretion
As with the Juvenile Civil Citation process, the officer will: investigate the incident; determine any existence of probable cause; advise the offender of Miranda Warnings and obtain an admission; determine eligibility of diversion for the offender; and offer the offender the choice of diversion with information (pamphlet of program). If it is determined that an adult civil citation is not the appropriate action, the officer is to cite the reason in their report.
If the offender is offered and accepts the citation, the offender has up to 7 days, as established by the law enforcement committee, from the date of the issuance, to schedule an appointment for intake and assessment with the program provider. When the initial appointment is scheduled, the offender is requested to bring with them specific information to their initial appointment. If the offender has not made contact with the provider within the established time period, two documented attempts will be made to contact the offender before the referral is returned to the referring law enforcement agency’s liaison for further action.Frequently Asked Questions
