Eligibility
T
he discretion of law enforcement officers to issue citations is based solely on the criteria established by each jurisdiction. Factors to be considered when determining criteria might include, but not limited to: age range; county or circuit of residence; prior adult criminal history; prior juvenile history; eligible offenses; ineligible offenses; verifying eligibility; time frame to contact program provider; assignment of community service hours; and documentation of why a citation was not issued for eligible situation.

The following factors have been considered by the law enforcement committee of the Adult Civil Citation program in the Second Judicial Circuit of Florida and have established the following offenses.
- Age Range
- County or Circuit of Residence
- Prior Adult Criminal History
- Prior Juvenile History
- Eligible Offenses
- Ineligible offenses
- Verifying Eligibility
- Contact Time Frame
- Community Service Hours
- Documentation of Eligible Situation.
- Adult 18 years or older
- No age cap
- Must reside within the 2nd Judicial Circuit
- First time offender
- Officers must check NCIC, JIS and EVS. Any previous history will make them ineligible, including cases that have been “nolle prossed”
- An adult who has received a Juvenile Civil Citation in the past is eligible;
- Contact program provider within 7 days of citation issuance
- If offender does not wish to participate in the pilot program, determine if a NTA or detention is best course of action
- Provide documentation in case narrative why the ACC was not utilized
- Assign Community Service Hours (25 hours)
- Traffic Offenses
- Domestic violence related offenses
- Stalking
- Exhibition Sexual Organs
- Loitering and Prowling
- Theft/Criminal Mischief in excess of $50.00 restitution
